Brainboot ("Brainboot", "we", "us") is a hosted platform for building, running, and sharing cognitive frameworks ("brains") that execute on top of large language models. These Terms of Service govern your access to and use of the Brainboot platform, including the web app, API, marketplace, and any related services (collectively, the "Service").
You must be at least 13 years old to use Brainboot. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. By creating an account, you represent that you meet these requirements.
If you use Brainboot on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or applicable law, with or without notice depending on the severity of the violation.
Brainboot routes prompts and completions to third-party large language model providers (listed in our Subprocessors page). We do not generate model outputs ourselves. We do not guarantee that any model output is accurate, complete, lawful, or fit for any particular purpose.
You use the Service and any outputs at your own risk. Do not rely on model outputs for medical, legal, financial, safety-critical, or life-impacting decisions without independent human review.
You retain ownership of all content you submit to the Service, including prompts, brains you create, and conversation history ("Your Content").
By submitting Your Content, you grant Brainboot a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit Your Content solely to provide the Service. This license exists only while Your Content is on the Service and ends when you delete it, except to the extent we are required to retain it for legal or operational reasons.
If you publish a brain to the public marketplace, you additionally grant other Brainboot users a non-exclusive license to view, copy, and use that brain through the Service. You may remove a brain from the marketplace at any time.
You agree to comply with our Acceptable Use Policy. Violations may result in immediate suspension or termination.
Brainboot offers a free tier and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method automatically until you cancel.
Usage quotas reset at the start of each billing period. If you exceed your plan's quota, we may throttle your requests, charge metered overages (if enabled), or require an upgrade.
We reserve the right to change pricing at any time. Existing subscribers will receive at least 30 days' notice before a price change takes effect, and may cancel before the change applies.
Refunds are handled on a case-by-case basis. Unused subscription time is generally non-refundable.
To prevent runaway LLM costs, Brainboot enforces per-user daily and monthly limits on all plans, including paid tiers. We may throttle, queue, or reject requests that exceed these limits. We may also block specific models from specific plans to preserve service reliability and margin.
Brainboot, its logo, design, code, documentation, and underlying technology are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.
You may not copy, modify, reverse-engineer, or create derivative works of the Brainboot platform itself. This does not apply to brains or outputs you create with the Service, which are yours.
The Service relies on third-party infrastructure, including LLM providers. Your use of the Service is also subject to the terms and privacy policies of those providers. We do not control third-party providers and are not responsible for their acts or omissions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINBOOT'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, OR LOST DATA.
You agree to defend, indemnify, and hold harmless Brainboot and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party's rights.
You may cancel your account at any time through your account settings. We may suspend or terminate your account immediately if you violate these Terms, the Acceptable Use Policy, or applicable law. Upon termination, your right to access the Service ends and we may delete Your Content after a reasonable retention period.
We may update these Terms from time to time. If a change is material, we will notify you by email or in-app notice at least 14 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which Brainboot is established, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction, except where mandatory consumer protection law requires otherwise.
